1. Acceptance of Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "Parent," or "Guardian") and Phonixo Reader ("we," "us," or "our") governing your use of the Phonixo Reader mobile application ("App"), available on the Apple App Store and Google Play Store.
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not download or use the App.
If you are using the App on behalf of a child under the age of 13 (or under 16 in the EEA/UK), you, as the parent or legal guardian, agree to these Terms on behalf of your child and are responsible for their use of the App.
2. Eligibility & Parental Consent
Phonixo Reader is an educational application designed for children ages 3 to 7 years old, under the supervision or account management of a parent or guardian.
- Account creation requires the account holder to be 13 years of age or older. Parents and guardians must create and manage accounts used by younger children.
- If we learn that personal information has been collected from a child under 13 without verifiable parental consent, we will delete that information promptly.
- By creating an account or making in-app purchases, you represent that you are at least 13 years old (or 16 in the EEA/UK), or are a parent/guardian acting on behalf of your child.
3. License & Permitted Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial educational purposes.
You May:
- Install and use the App on devices you own or control.
- Allow your child to use the App under your supervision.
- Access content unlocked through legitimate in-app purchases.
You May Not:
- Copy, modify, distribute, sell, or lease any part of the App or its content.
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Remove, obscure, or alter any copyright, trademark, or other proprietary notices.
- Use the App for any commercial purpose without our express written consent.
- Circumvent any technical protection measures or content restrictions.
- Access the App through unauthorized means, including bots or automated tools.
4. Accounts & Authentication
The App uses Google Sign-In via Firebase Authentication for account creation. By signing in with Google, you are also subject to Google's Terms of Service and Privacy Policy.
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately at support@phonixo.com if you suspect unauthorized account access.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. In-App Purchases
Free Content
Phonixo Reader is free to download and includes a core set of sight words at no charge. No payment is required to access the base content.
Premium Word Packs
Additional themed word packs are available as optional one-time in-app purchases. Prices are displayed clearly before purchase and are set in your local currency by Apple or Google.
Payment Processing
All payments are processed by Apple (App Store) or Google (Play Store). We do not store your payment information. Purchases are subject to the respective platform's Terms of Sale.
No Subscriptions
Phonixo Reader does not offer auto-renewing subscriptions. All in-app purchases are one-time payments for permanent access to that content.
Refund Policy
Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly. To request a refund:

Restoring Purchases
Purchases can be restored at any time on any device signed in to the same Apple ID or Google Account used for the original purchase, at no additional cost.
Parental Guidance: We recommend enabling parental purchase controls on your device to prevent unintended purchases by children. On iOS, use Screen Time purchase restrictions; on Android, use Google Play's Parental Controls or Family Link.
No Advertising
Phonixo Reader contains no advertisements. We do not serve third-party ads, and we do not collect data for advertising purposes.
6. Prohibited Conduct
You agree not to:
- Attempt to gain unauthorized access to our servers, backend systems, or other users' accounts.
- Interfere with or disrupt the integrity or performance of the App or its infrastructure.
- Upload or transmit viruses or any other malicious code.
- Use the App in any manner that could harm children or exploit minors.
- Violate any applicable local, national, or international law or regulation.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
7. Intellectual Property
All content within the Phonixo Reader App — including but not limited to text, graphics, illustrations, animations, sounds, interface design, word content, and software code — is owned by or licensed to Phonixo Reader and is protected by copyright, trademark, and other intellectual property laws.
"Phonixo Reader" and associated logos are trademarks of Phonixo Reader. You may not use these marks without our prior written permission.
Nothing in these Terms grants you ownership of any intellectual property rights in the App or its content.
8. App Content & Educational Material
Phonixo Reader provides educational content (sight words, sentences, exercises) designed for early childhood literacy development. While we endeavor to provide accurate and effective educational content:
- The App is intended as a supplement to, not a replacement for, formal education or professional educational guidance.
- Educational outcomes may vary between individual learners.
- We may update, add, or remove content within the App at any time to improve quality or accuracy.
Content is designed for English-language sight word learning. Localization to other languages may be available in future versions.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or free of viruses.
- Results from using the App will meet your expectations.
- All content will be accurate, complete, or current at all times.
Some jurisdictions do not allow the exclusion of implied warranties, so these exclusions may not apply to you.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Phonixo Reader, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, data, use, goodwill, or other intangible losses.
- Damages resulting from unauthorized access to or alteration of your data.
- Any matter relating to the App beyond the amount you paid us in the last twelve (12) months (or $10 USD if you paid nothing).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of these limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Phonixo Reader and its affiliates from any claims, damages, obligations, losses, liabilities, costs, or debt arising from:
- Your violation of these Terms.
- Your violation of any third-party rights, including intellectual property or privacy rights.
- Any claim that your use of the App caused damage to a third party.
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property provisions, warranties, indemnity, and limitations of liability) shall survive termination.
You may terminate your account at any time by contacting us at support@phonixo.com or by deleting the App and requesting data deletion per our Privacy Policy.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
Informal Resolution
Before filing any formal dispute, you agree to contact us at support@phonixo.com and attempt to resolve the dispute informally. We will attempt to resolve most issues within 30 days.
App Store Platforms
If you obtained the App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms as a third-party beneficiary. Your use is also subject to the Apple Media Services Terms and Conditions.
If you obtained the App from Google Play, your use is subject to Google Play's Terms of Service.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by:
- Updating the "Last Updated" date at the top of this page.
- Sending a push notification or in-app alert.
Your continued use of the App after changes become effective constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the App.
